Whether you are a bank, financial institution, individual investor or alternative lender, when providing funding secured by real estate it is essential that your interests are properly protected. Our property finance team work with and on behalf of lenders and borrowers to ensure all security is appropriate and as agreed and offer tailored, commercial and proportionate advice at all stages of the process. We also advise on deals involving foreign jurisdictions and complex regulatory requirements on a regular basis.

Collaborating closely with our Corporate Team , we can assist with all stages of the secured lending process including:

  • full legal due diligence into properties, including title reviews and analysis of searches
  • drafting, reviewing, negotiating and advising on forms of legal charge
  • drafting, reviewing, negotiating and advising on deeds of priority
  • drafting, reviewing, negotiating and advising on ancillary security documentation such as debentures and personal guarantees
  • dealing with perfection of security including all relevant registrations at Companies House and the Land Registry

Our Commercial Property Team has been involved in a number of high-profile matters. Highlights include:

  • acting for a leading PLC bank client in connection with a multi-million pound development finance revolving credit facility in relation to a UK-wide network of residential development schemes
  • advising a PLC bank client in connection with a £4m loan to prestigious private education establishment secured by a multi-million pound property portfolio
  • acting on almost 100 matters for Svenska Handelsbanken AB (publ)  and over 100 matters for private bank Arbuthnot Latham & Co
