Professional negligence

Professional negligence disputes are always sensitive and can have considerable impact on a business’s reputation or an individual’s future. Our team of professional negligence specialists have extensive experience and expertise in dealing with claims involving a wide range of professionals, and in resolving them using alternative dispute resolution (ADR) procedures.

Bespoke, expert support

To deliver the strongest outcome for your case, we devise a bespoke strategy at an early stage, communicating clearly the risks and benefits. Where possible, we seek an early cost-effective resolution, and our ADR-trained litigators will guide you expertly through this process. However, if your case does proceed further, our litigators have an excellent track record in working with our clients and counsel to achieve success in the Courts – employing a robust approach in line with your commercial goals.

Whatever the direction of your dispute, we draw on expertise from across our firm and external network of counsel and specialists to provide you with comprehensive support. Where appropriate, we work with your insurers or look at external litigation funding and the use of insurance to hedge your risks. We also aim to provide alternative fee budget options where possible, and our transparent approach to fees is designed to help you manage the process with clarity.

Our Disputes Team has been involved in a number of high-profile professional negligence cases. Highlights include:

  • acting for a business in a professional negligence claim against their tax advisors. We were able to recover tax losses before the issue of Court proceedings
  • acting in a professional negligence case against a firm of Solicitors concerning the way they conducted a litigation case. We were successful in resolving the claim before litigation proceedings

  • defending financial advisers and pension scheme administrators against complaints brought before the Financial and Pensions Ombudsmen
  • acting in an £8 million claim for negligence against a firm of Solicitors in relation to a property transaction

In addition to interim and terminal claims, our dilapidation specialists also deal with:

  • accounting and auditing issues
  • actuarial issues
  • architects
  • design and patent problems
  • engineering disputes
  • financial advice issues

  • incorrect tax advice
  • investment management
  • legal advice issues (Barristers and Solicitors)
  • pensions advice
  • surveying and planning errors

The lawyers met and managed what were, at times, very short deadlines and I was very impressed.
