Partner - Head of Planning and Environmental
Alex advises on both contentious and non-contentious planning matters covering residential development, retail and leisure, agricultural development, waste planning and renewables. His practice covers the preparation and drafting of infrastructure agreements (including section 106 agreements) and applications, planning appeals, planning enforcement and challenges to Appeal decisions in the High Court and judicial review proceedings. Alex also advises on the EIA Regulations and offences involving Listed Buildings and Tree Preservation Orders. He is also experienced with advising on Town and Village Green Applications, Assets of Community Value and the Permitted Development Rights regime.
Alex also advises on environmental matters including statutory nuisance and abatement notice appeals, offences relating to controlled waste, pollution, waste packaging, Environmental Permitting and the civil sanctions regime. He also advises corporate clients on liability issues connected to the contaminated land regime and compliance with REACH issues.
Alex is a member of UKELA and sits on the Somerset branch of the CLA committee. Alex also speaks on planning and environmental matters at national conferences run by leading industry bodies such as the NFU, CLA, BIAC and RICS.
Key Experience
Alex’s relevant experience includes:
- negotiating/drafting complex section 106 agreements – recent examples include a mixed use scheme (residential and retail) comprising 230 units & 465 m2 of retail space and a residential scheme comprising 350 units and a primary school
- bringing and defending judicial review proceedings for developer clients and resident groups against decisions of Local Planning Authorities
- defending injunctive proceedings issued by a Local Planning Authority relating to an alleged breach of planning control in connection with a farm diversification project
- successfully appealing planning enforcement notices relating to the conversion of a redundant farm building into a residential dwelling
- defending prosecutions brought by the Environment Agency and Local Authorities for controlled waste offences and obtaining cost awards
- successfully appealing abatement notices relating to odour, noise and insects
- securing enforcement undertakings with the Environment Agency for offences under the Environmental Permitting Regulations and the Salmon and Freshwater Fisheries Act
