Farmers Weekly Business Clinic: Customer recourse on faulty farming equipment

The owner of a sizeable dairy farm has decided to invest in new machinery with the aim of expanding the business and increasing its profits.

But the new milking robots – purchased to replace an existing herringbone parlour milking system – are proving to be unreliable, leaving the farmer both frustrated and distressed.

In this month’s Business Clinic, Robert James, an associate in Thrings’ Agriculture team, discusses the recourse options available to the farmer, including whether the robot manufacturer’s apparent failure to meet its commercial obligations could lead to a claim for breach of contract.
